Being the only males in our group we bonded quickly. He impressed me with his passion to the cause of access and his dedication to BCIL as a volunteer there.&lt;span style=""&gt;  &lt;/span&gt;Persons of his drive are invaluable to the inclusion of all.&lt;span style=""&gt;  &lt;/span&gt;Jeff and those like him make our community a better place. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;    &lt;p class="MsoNormal"&gt;&lt;span style=""&gt;Jeff and I had the same level injury and both attended UMass Boston, giving us plenty to talk about.&lt;span style=""&gt;  &lt;/span&gt;I enjoyed chatting with him as he was a sincere humorous man, caring and interested in a variety of subjects.&lt;span style=""&gt;  &lt;/span&gt;Jeff’s wry humor always came through and brightened our talks.&lt;span style=""&gt;  &lt;/span&gt;Any topic might come from him - from his take on a school issue to the ways we adapted to frustrations of our personal situations. No matter the content, our conversations always were heartfelt. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;    &lt;p class="MsoNormal"&gt;&lt;span style=""&gt;Jeff always rose to the challenge, be it a tough academic course or managing the struggles of our daily existence.&lt;span style=""&gt;  &lt;/span&gt;I felt his integrity and love for life. He had come far in his new world and was succeeding in school, making his loss all the more difficult for those of us who shared time with him.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;    &lt;p class="MsoNormal" style=""&gt;&lt;span style=""&gt;Our connection is one that will always stay with me, and no doubt, will buoy me through rough waters at some point. Thank you my friend. It wasn’t fair. Her health wasn’t great but a wheelchair repair service flipped her into the next world, if there is one, and she was much too young too die.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;I was invited to her house when I was trying to recruit &lt;st1:place st="on"&gt;Dorchester&lt;/st1:place&gt; folks for a neighborhood meeting. She not only let me in but she offered the building’s community room for meetings. She had never been an activist but she was active in her life. She was looking for work, fixing up her apartment, and applying for a working dog, which she did get and whom she loved very much.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;I was so thrilled when the “shy” activist agreed to file an access complaint when the City ripped up her street leaving her no way to get around without riding in the street. For the first time she filled out the form and even took pictures.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;My favorite memory of Kia was the night of the great Target sting, where she, &lt;st1:personname st="on"&gt;Alyson Perry&lt;/st1:personname&gt; (and Saddle, her guide dog) and I strolled through the store because two blind consumers had been tossed from Target for bringing in their dogs. Alyson and I were used to causing trouble but Kia was new at it and she was great. She worked the last 20 years helping ensure that people with disabilities could live independently, first at the Boston Center for Independent Living, then at Neighborhood Health Plan.&lt;br /&gt;&lt;br /&gt;I met her back in the 1980s at BCIL, and she was a neighbor of mine for a few years in the Fenway before she got married to Peter Laitinen.  She was socially graceful, smart, and down to earth.  She was fun to work with.&lt;br /&gt;&lt;br /&gt;In addition to &lt;a href="http://www.boston.com/news/globe/obituaries/articles/2007/10/17/betsy_laitinen_indomitable_advocate_for_those_with_disabilities/"&gt;her obituary in October,&lt;/a&gt; the Globe published &lt;a href="http://www.boston.com/travel/getaways/us/hawaii/articles/2005/10/30/advance_planning_counts_for_less_than_resilience_on_hawaii_adventure/"&gt;an article about the trip she took &lt;/a&gt;with her friend Barbara Hantz  to Hawaii in 2005.&lt;br /&gt;&lt;br /&gt;The following appreciation is written by &lt;a href="http://www.neighborhoodaccess.org/2005/10/liz-casey-hates-bricks-too.html"&gt;Liz Casey&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;When Betsy Laitinen came into a room, all were touched by her warm hello, her steady manner and intelligence, and her ticklish wit.&lt;br /&gt;&lt;br /&gt;Part of the independent living movement in its early days, she worked at BCIL for many years in many capacities.  It was there she met her loving husband of 10 years, Peter Laitinen.  After she experienced a stroke in 2001, Betsy fought her way back from a collapsed lung, and then endured the loss of Peter, all in the same year. The sustenance of family, friends, colleagues, and her home (and doggie), which Betsy maintained a deep commitment to, then had a chance to give back to her.&lt;br /&gt;&lt;br /&gt;Over the last several years, Betsy held the rudder as Chairperson of the Board at Boston Community Medical Group, where she will be sorely missed.  With a degree in business from Bentley College, she would sort out the details for those of us less inclined.  And she would keep us laughing.&lt;br /&gt;&lt;br /&gt;She also worked as a Standardized Patient Educator at Tufts New England Medical School, teaching medical students about disability awareness.&lt;br /&gt;&lt;br /&gt;Watching Betsy the last night I visited with her, sharing a glass or two of Chardonnay, and having a howl over something or other with her niece and our PCAs, I thought "this woman seems indestructible".  And now I know she is. Kelly&lt;br /&gt;&lt;br /&gt;When Boston Herald photographer &lt;a href="http://www.neighborhoodaccess.org/2007/12/nag-holiday-party-herald-tomorrow.html"&gt;Lisa Hornak and I got stymied at the intersection &lt;/a&gt;of Westland Avenue and Hemenway Street last Saturday, Christopher "Tiger" Southridge, acting captain of the Inspectional Services Department (ISD), pulled his car over and came over to talk to us.&lt;br /&gt;&lt;br /&gt;A very nice guy who seemed committed to his work, Tiger's description of city policy regarding citations for snow removal violations dumbfounded me. He said that the city would not write a ticket for a snow-bound curb cut because -- here comes the answer --  it's not part of the sidewalk!  A curb cut, so the higher-ups have determined, is an "entrance to a site," and ISD doesn't write tickets for "entrances to sites."  (Perhaps even more unbelievably, it's not even a violation to leave a fire hydrant covered over and obscured by snow.)&lt;br /&gt;&lt;br /&gt;I went on the city of Boston website, and this bizarre interpretation of the law can be found in the &lt;a href="http://www.cityofboston.gov/isd/pdfs/cepbrochure.pdf"&gt;brochure&lt;/a&gt; of the &lt;a href="http://www.cityofboston.gov/isd/cep/default.asp"&gt;Code Enforcement Police&lt;/a&gt;  -- the ISD division which enforces city codes.&lt;br /&gt;&lt;span style="font-weight: bold;font-size:130%;" &gt;&lt;/span&gt;&lt;blockquote&gt;&lt;span style="font-weight: bold; color: rgb(51, 102, 255);font-size:100%;" &gt;What is a property owner required to&lt;br /&gt;shovel?&lt;/span&gt;&lt;br /&gt;All sidewalks and walkways that abut the&lt;br /&gt;property. For example if the property is&lt;br /&gt;on a corner lot the property owner must&lt;br /&gt;shovel the front and side walkway that&lt;br /&gt;abut the property.&lt;br /&gt;&lt;span style="color: rgb(0, 153, 0); font-style: italic;"&gt;Note a kind gesture: shovel handicap &lt;/span&gt;&lt;br /&gt;&lt;span style="color: rgb(0, 153, 0); font-style: italic;"&gt;ramps, fire hydrants and city sewers.&lt;/span&gt;&lt;/blockquote&gt;"Note a kind gesture" may be an awkward phrase , but the voluntary nature of its request is clear.  It's never occurred to me that curb cuts, an integral part of the public right of way, might not be considered "sidewalks."  But maybe this brochure, apparently written September 5, 2006 (check the "document properties"), is out of date and was mistakenly left up on the website. (The information about snow removal requirements at the &lt;a href="http://www.cityofboston.gov/isd/cep/codes.asp"&gt;"Codes Enforced"&lt;/a&gt; page is also obsolete.)&lt;br /&gt;&lt;br /&gt;You might have a hard time finding it, but there is a more recent document discussing specific snow removal responsibilities.  It's not at "&lt;a href="http://www.cityofboston.gov/snow/winter.asp"&gt;Know Snow&lt;/a&gt;, The City's Snow Information and Advisory Program",  where you might expect to find information that could determine whether you get a ticket or not, but rather stashed under "Reports, Publications and Forms" at t&lt;a href="http://www.cityofboston.gov/isd/"&gt;he Inspectional Services Department webpage&lt;/a&gt;.&lt;br /&gt;&lt;br /&gt;If anyone has seen &lt;a href="http://www.cityofboston.gov/isd/pdfs/snow.pdf"&gt;this document&lt;/a&gt; before, I would love to hear  about it, but I have a feeling the timing of its production ("document properties" again) -- 12:10 p.m. on December 13, just as the snow was beginning to fall in the Thursday afternoon storm that paralyzed the region and unleashed round after round of finger-pointing -- might be a bit embarrassing for the city. The document begins:&lt;br /&gt;&lt;br /&gt;   The Inspectional Services Department wants you to know…&lt;br /&gt;                   The City of Boston made a few changes to the Law….&lt;br /&gt;&lt;div style="text-align: right;"&gt;Regarding Snow!&lt;br /&gt;&lt;/div&gt;&lt;div style="text-align: center;"&gt;&lt;span style="font-weight: bold;"&gt;In Summary, Unshoveled Sidewalks Must Go! &lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;br /&gt;Then it asks the question:&lt;br /&gt;&lt;blockquote&gt;&lt;div style="text-align: center;"&gt;&lt;span style="font-size:130%;"&gt;How Much Snow Should the Property Owner Shovel?&lt;/span&gt;&lt;/div&gt; &lt;/blockquote&gt;&lt;div style="text-align: center;"&gt;&lt;blockquote&gt; Snow removal should cover the full paved width of the sidewalk or a minimum of 42 inches wide. Narrow paths encumber carriages and wheelchairs causing a rough ride! &lt;/blockquote&gt;&lt;div style="text-align: left;"&gt;Here at last is some specific information, and it sounds sounds pretty good, until you read over the final section, which reproduces the charitable language of the Code Enforcement Police brochure:&lt;br /&gt;&lt;/div&gt;&lt;/div&gt;&lt;br /&gt;&lt;div style="text-align: center;"&gt;&lt;span style="font-size:130%;"&gt;Remember to be a Good Neighbor &lt;/span&gt;&lt;br /&gt;&lt;/div&gt;&lt;blockquote&gt; Check and help out your elderly neighbors;&lt;br /&gt;Clear any snow around the sewer/catch basin in front of your home;&lt;br /&gt;Clear any snow that may be blocking a handicap ramp;&lt;br /&gt;Do not over exert yourself when removing snow and;&lt;br /&gt;Shovel out your fire hydrant.&lt;br /&gt;&lt;/blockquote&gt;Not over exerting yourself and shoveling out a curb cut really are two separate subjects, but according to the city, they are similar in that they are good ideas which we all should volunteer to follow.  Just not the law.&lt;br /&gt;&lt;br /&gt;What is the adjective to describe this city's antics?  &lt;a href="http://www.neighborhoodaccess.org/2007/12/bostons-new-snow-removal-ordinance.html"&gt;The snow removal ordinance,&lt;/a&gt; first submitted by former city councilor Felix Arroyo in 2005, was the subject of a hearing last May.  The commissioners of inspectional services and public works testified.  Later, the city said it wanted some time to think about it, but then endorsed it after running it by both Public Works and Inspectional Services.&lt;br /&gt;&lt;br /&gt;Here is the title of the ordinance:&lt;br /&gt;&lt;blockquote style="font-weight: bold;"&gt;&lt;span style="font-size:130%;"&gt;AN ORDINANCE REGARDING&lt;br /&gt;THE PROMPT AND COMPLETE&lt;br /&gt;REMOVAL OF SNOW AND ICE FROM SIDEWALKS&lt;br /&gt;AND ABUTTING CURB RAMPS&lt;/span&gt;&lt;/blockquote&gt;What does the last line read? Kelly&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style=""&gt;&lt;span style=""&gt;&lt;br /&gt;It was such a beautiful day today, I took a little access-inspection walk.&lt;span style=""&gt;  &lt;/span&gt;Although I could see a lot of sidewalk concrete from my window, I found that the sidewalk along both the Fenway and both sides of &lt;st1:street st="on"&gt;&lt;st1:address st="on"&gt;Agassiz Road&lt;/st1:address&gt;&lt;/st1:Street&gt; were impassable.&lt;span style=""&gt;  &lt;/span&gt;The inaccessibility of the Fenway sidewalk means that I cannot go south on the Fenway, because the building side lacks curb cuts down at the Forsyth Institute.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style=""&gt;&lt;span style=""&gt;On the less-blocked &lt;st1:place st="on"&gt;Agassiz&lt;/st1:place&gt; sidewalk, I ran into a neighborhood wheelchair user who complained bitterly about the crappy sidewalks.&lt;span style=""&gt;  &lt;/span&gt;She said her six wheel Jazzy wheelchair did pretty well on the snow and ice (I'm shopping for a new chair, and am definitely done with Invacare 6 wheelers, which have terrible suspension and can barely back up in the best conditions). I ran into another wheelchair user who, like me, was in the middle of &lt;st1:street st="on"&gt;&lt;st1:address st="on"&gt;Agassiz   Road&lt;/st1:address&gt;&lt;/st1:Street&gt;.&lt;span style=""&gt;  &lt;/span&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style=""&gt;&lt;st1:personname st="on"&gt;&lt;span style=""&gt;Chris Hart&lt;/span&gt;&lt;/st1:PersonName&gt;&lt;span style=""&gt; from Adaptive Environments sent along a couple of articles from the December 20 edition of the Dorchester Reporter, in which editor &lt;a href="http://www.dotnews.com/snowscofflaws.html"&gt;Bill Forry detailed&lt;/a&gt; the new snow ordnance (no other newspaper bothered) and described a ride he took with code enforcement supervisor&lt;/span&gt; Captain Michael Mackan,  who wrote a number of tickets to Dorchester businesses.&lt;/p&gt;  &lt;p class="MsoNormal" style=""&gt;"I think these increased fines may give a bit more incentive. I have noticed an improvement in some parts of the city, " Mackan said. &lt;/p&gt;  &lt;p class="MsoNormal" style=""&gt;Forry observes that it isn't just businesses slipping up.&lt;span style=""&gt;  &lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;/p&gt;&lt;blockquote&gt;&lt;p class="MsoNormal"&gt;On a brief driving tour, the Reporter spotted a number of municipal and state properties that were also in violation of the city ordinance to clear a 42" wide path, enough to allow passage for a wheelchair. The Morrissey Boulevard sidewalk along the MBTA-owned JFK-UMass station grounds was still a frozen tundra on Tuesday, with high school students and other pedestrians seen taking their chances on the busy roadway. Mackan placed a stern call to an MBTA representative with a warning that a ticket would be forthcoming if the transit agency didn't fix the problem. In Fields Corner, where residents have complained of poor shoveling at the T station in years past, the sidewalks were clear. Mackan wanted to know if the T somehow misplaced their shovels at JFK-UMass.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;The city of &lt;st1:place st="on"&gt;&lt;st1:city st="on"&gt;Boston&lt;/st1:City&gt;&lt;/st1:place&gt; had its share of fall-downs too. Mackan called the city's Parks Department, which is responsible for clearing walks along their land. Kelly&lt;/p&gt;&lt;p class="MsoNormal"&gt;All-around Herald reporter &lt;st1:personname st="on"&gt;Marie  Szaniszlo&lt;/st1:PersonName&gt; got a breather from covering stories of murder and mayhem with a page 2 article today  on sidewalk access.&lt;span style=""&gt;  &lt;/span&gt;In "&lt;a href="http://www.bostonherald.com/news/regional/general/view.bg?articleid=1062343"&gt;Judge Upholds Fines vs Hub,"&lt;/a&gt; she reports on the recent decision of Suffolk Superior Court Justice Paul E. Troy against the city of &lt;st1:place st="on"&gt;&lt;st1:city st="on"&gt;Boston&lt;/st1:City&gt;&lt;/st1:place&gt;, which in its second losing appeal against the Architectural Access Board's order that it repair &lt;st1:street st="on"&gt;&lt;st1:address st="on"&gt;Huntington   Avenue&lt;/st1:address&gt;&lt;/st1:Street&gt;, tossed up a kitchen sink full of arguments that didn't hold water.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;I am quoted saying &lt;span style=""&gt;“The court’s decision exposes the city as a two-year-long scofflaw.”&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;Szaniszlo reports that the $500 per day fine levied by the AAB on the city for not fixing the all-brick sidewalk is now up over $376,000. Kelly&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;br /&gt;Herald reporter &lt;st1:personname st="on"&gt;Marie Szaniszlo&lt;/st1:PersonName&gt;, who did the &lt;st1:city st="on"&gt;&lt;st1:place st="on"&gt;Huntington&lt;/st1:place&gt;&lt;/st1:City&gt; brick sidewalk story last August 26, got a very friendly photographer to accompany me on my trip to Symphony Plaza East for the NAG holiday party.  It turned out that the little orphan sidewalk at the end of my service road, and the main sidewalk heading towards the Westland Gates were icy and slushy, but barely passable. I thought we were home free until we arrived at the Westland Gates, where a cleared area looking like a curb cut turned out to be the area &lt;span style="font-style: italic; font-weight: bold;"&gt;between &lt;/span&gt;the two curb cuts.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;As we sat there, an Inspectional Services Division car went by, and Lisa recognized the official.&lt;span style=""&gt;  &lt;/span&gt;He turned out to be Christopher Southridge, a.k.a. "Tiger," whom Lisa had followed for more than a year in what looks to have been a pretty successful attempt to lose lots of weight.&lt;span style=""&gt;  &lt;/span&gt;Tiger is the (an?) acting captain of ISD, and told us it was he who followed up on the violations pictured in t&lt;a href="http://flickr.com/photos/neighborhood_access_group/sets/72157603470079075/"&gt;he Flickr set from December 15&lt;/a&gt;.&lt;span style=""&gt;  &lt;/span&gt;Inspectors wrote a number of tickets, including Cappy's Pizza, &lt;a href="http://flickr.com/photos/neighborhood_access_group/2127850362/in/set-72157603515521206/"&gt;Burger King&lt;/a&gt; on &lt;st1:street st="on"&gt;&lt;st1:address st="on"&gt;Huntington Avenue&lt;/st1:address&gt;&lt;/st1:Street&gt;, and Symphony Plaza West -- an especially egregious violator because it is a housing development for elderly and disabled people.&lt;span style=""&gt;  &lt;/span&gt;&lt;span style=""&gt; &lt;/span&gt;It was gratifying to see a clear curb cut in front of Cappy's for the first time in 10 days.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;I told Tiger that the island on &lt;st1:street st="on"&gt;&lt;st1:address st="on"&gt;Huntington Avenue&lt;/st1:address&gt;&lt;/st1:Street&gt; between Horticultural Hall and Symphony Plaza East (&lt;a href="http://flickr.com/photos/neighborhood_access_group/2127073493/in/set-72157603515521206/"&gt;&lt;st1:place st="on"&gt;&lt;st1:placename st="on"&gt;Menino&lt;/st1:PlaceName&gt;  &lt;st1:placetype st="on"&gt;Island&lt;/st1:PlaceType&gt;&lt;/st1:place&gt;)&lt;/a&gt; was blocked yesterday, and he asked whether I had checked it today.&lt;span style=""&gt;  &lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;I will do a longer post soon on all that I learned from him.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;Not able to get down the corner at Westland , I turned south down Hemenway Street, and struggled over &lt;a href="http://flickr.com/photos/neighborhood_access_group/2127071617/in/set-72157603515521206/"&gt;a stretch of ice also belonging to DCR&lt;/a&gt;, then went left onto Symphony Road (snowed under sidewalks, but they're unusable even in the summer), and another left onto St. Stephen street, with its tree-heaved&lt;span style=""&gt;  &lt;/span&gt;sidewalks.&lt;span style=""&gt;  &lt;/span&gt;We got over to &lt;st1:place st="on"&gt;&lt;st1:placename st="on"&gt;Menino&lt;/st1:PlaceName&gt; &lt;st1:placetype st="on"&gt;Island&lt;/st1:PlaceType&gt;&lt;/st1:place&gt;, which was untouched since yesterday and totally icebound.&lt;span style=""&gt;  &lt;/span&gt;So I had to wiggle past a car on &lt;st1:street st="on"&gt;&lt;st1:address st="on"&gt;Huntington   Avenue&lt;/st1:address&gt;&lt;/st1:Street&gt;, and use the U-turn lane to get over to Symphony Plaza East.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;Lisa left after we arrived at Symphony Plaza East, and we had a fun little party, complete with &lt;st1:personname st="on"&gt;Boston Globe&lt;/st1:PersonName&gt;s from the morning. Kelly&lt;br /&gt;&lt;br /&gt;Eileen Brewster called from her medical appointment this morning, At Barron Chiropractic and Rehabilitation, 1520 Blue Hill Ave.  Eileen has been going there for five years, and was told that other clients using wheelchairs also come to the office, but both last Saturday and this Saturday, she was unable to get up the curb cut at the corner of Blue Hill Avenue and Fremont Street.  So she had to travel, in the street, down very busy Blue Hill Avenue for access. Very, very dangerous.&lt;br /&gt;&lt;br /&gt;Last week, the chiropractor Jeremiah DiRuzzo cleared the curb cut himself, and assured Eileen that it would be taken care of for this Saturday. Kelly&lt;br /&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;In light of Andrea Estes' pending Globe story, the city frantically tried to solve the immediate problem of Eileen Brewster not being able to leave BHA property for our holiday party.&lt;br /&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;Although Eileen has complained many times before about access around her apartment on &lt;st1:street st="on"&gt;&lt;st1:address st="on"&gt;Ruggles   street, &lt;/st1:address&gt;&lt;/st1:Street&gt; little has ever been done. Now, suddenly, she receives a personal telephone call from &lt;a href="http://www.bostonhousing.org/admin_message.html"&gt;Sandra Henriquez&lt;/a&gt;,  Administrator/CEO of the Boston Housing Authority. Henriquez wanted to know what was wrong, so Eileen told her the same thing she later told &lt;st1:personname st="on"&gt;Andrea  Estes&lt;/st1:PersonName&gt;, that she could see blocked sidewalks from her window, and the curb cuts for crossing Leon street towards northeastern and Ruggles Station were impassable, and have always been impassable. &lt;br /&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt; The manager of the Alice Heyward Taylor apartments showed up next, the walkway and Eileen's parking space were cleared, but &lt;b&gt;&lt;i&gt;the manager then told Eileen that the curb cuts for the &lt;st1:street st="on"&gt;&lt;st1:address st="on"&gt;Leon   street&lt;/st1:address&gt;&lt;/st1:Street&gt; crosswalk didn't belong to the BHA, but to the city of &lt;st1:city st="on"&gt;&lt;st1:place st="on"&gt;Boston&lt;/st1:place&gt;&lt;/st1:City&gt;!&lt;/i&gt;&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;So even though employees of the city of &lt;st1:city st="on"&gt;&lt;st1:place st="on"&gt;Boston&lt;/st1:place&gt;&lt;/st1:City&gt; were out at Alice Taylor shoveling sidewalks, they were not going to touch a nearby curb cut -- because &lt;b&gt;&lt;i&gt;it belonged to a separate agency&lt;/i&gt;&lt;/b&gt; within city government.  My goodness.&lt;br /&gt;&lt;br /&gt;Eileen called back Sandra Henriquez, who said that she would try to get those curb cuts cleared. This stimulated another great bunch of comments, ranging from outright hostility to identification.&lt;br /&gt;&lt;br /&gt;His earlier posting and link to a &lt;a href="http://flickr.com/photos/neighborhood_access_group/sets/72157603470079075"&gt;set of NAG Flickr photos from December 15&lt;/a&gt; seems to have had temporary impact upon the city, as an official told the Globe that it had compiled a five-page list of violations addressed. Reporter Andrea Estes' telephone calls stirred more action today, from the city and state.&lt;br /&gt;&lt;br /&gt;But as this &lt;a href="http://flickr.com/photos/neighborhood_access_group/sets/72157603515521206/"&gt;latest Flickr set of photographs show&lt;/a&gt;, nothing much has changed in the Fenway. DCR properties are still snowbound, and this city-owned island between Horticultural Hall and Symphony Plaza East, where our holiday party will be held, is still dangerously icy. Private property owners such as the Boston Symphony Orchestra and the New England Conservatory continue violating with impunity.&lt;br /&gt;&lt;br /&gt;Has anyone ever pondered the notion that it might be counterproductive to entrust enforcement of a regulation (snow removal from sidewalks and curb cuts) with an entity (city of Boston) whose self-interest is in its own continual massive violation of that ordinance? &lt;br /&gt;&lt;br /&gt;The city is simply not willing to spend the money to clear sidewalks and curb cuts effectively.  No wonder inspectional services told the Boston Globe on Wednesday that it had "opted" not to ticket the state, because    &lt;p class="MsoNormal" style=""&gt;&lt;span style=""&gt;&lt;blockquote&gt;"The state's got a large area," said Boston Police Captain Michael Mackan, who heads code enforcement. "If we get a complaint about one of their areas or the MBTA's, I'll call them, and I know they'll get out there and take care of it. . . . Things fall through the cracks."&lt;/blockquote&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  It's the golden rule of government: do not unto others what you don't want them to do unto you. &lt;br /&gt;&lt;br /&gt;The brilliance of the Menino administration is in its ability to adjust course.  Deploying the enforcement version of Richard Nixon's "limited hang out" (telling a small truth to hide a bigger lie),  the city has now changed its mind and ticketed DCR. Why? Because of the prospect of an embarrassing newspaper article. Kelly&lt;br /&gt;&lt;br /&gt;Boston Globe Statehouse reporter Andrea Estes will have an article in tomorrow's paper about access in the Fenway and around Ruggles, and the struggle of our little group to have our holiday party. It seems that the &lt;a href="http://www.neighborhoodaccess.org/2007/12/open-letter-to-menino-and-patrick.html"&gt;open letter&lt;/a&gt; that Eileen Brewster and I sent Mayor Menino and Governor Patrick caught the interest of the globe city desk, because it asked Estes on her way to work to check access around Symphony Plaza East at 334 Mass Ave. (I realized the letter wasn't  specific on where the access problems were, but the story was powerful enough on its own.)&lt;br /&gt;&lt;br /&gt;DCR told Estes that it would be out in the Fenway at 4 p.m., and indeed a Department of Corrections crew was out there.  They chipped at the ice for a little while, threw down some salt, cleared about 50 feet of the path from my service road to the Westland Gates, but did nothing else.&lt;br /&gt;&lt;br /&gt;So the path a still isn't clear. I still can't go that way.&lt;br /&gt;&lt;br /&gt;Before DCR came, Lidia Alvarado went out and took a bunch of pictures, showing a variety of violators, from the Boston Symphony Orchestra to Cappy's pizza.  &lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;Unfortunately, the new snow removal ordinance passed in the city of &lt;st1:city st="on"&gt;&lt;st1:place st="on"&gt;Boston&lt;/st1:place&gt;&lt;/st1:City&gt; this fall has not resulted in an increased ability of our members to leave our houses.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;The Department of Conservation and Recreation, despite complaints to its Storm Center, its director of community relations, and to the office of the governor itself, has not cleared its sidewalks and crosswalks in the Fenway.&lt;span style=""&gt;  &lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;City agencies such as the Boston Housing Authority and the Department of Public Works have not cleared sidewalks and curb cuts under their responsibility.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;Many property owners in our neighborhood, including large institutions like &lt;st1:place st="on"&gt;&lt;st1:placename st="on"&gt;Northeastern&lt;/st1:PlaceName&gt;  &lt;st1:placetype st="on"&gt;University&lt;/st1:PlaceType&gt;&lt;/st1:place&gt; Kelly&lt;br /&gt;&lt;br /&gt;Last Monday evening, I sent an e-mail with map, along with photos of the problem sites, to one of Governor Patrick's assistants in the governor's office.  I wrote that&lt;br /&gt;&lt;br /&gt;&lt;blockquote&gt;the problem with DCR and snow is systemic and long-term.  It has never in my 20 years of living here followed requirements for clearing snow.  It seems to have long ago decided to ignore the Fenway except for a few sidewalks.  As far as I can tell, it doesn't bother with curb cuts (maybe because they have to be done by hand), and leaves quite a few sidewalks untouched, also.&lt;br /&gt;&lt;br /&gt;DCR came up with a snow removal priority plan, probably as a result of the West Roxbury high school students being hit on VFW Parkway three years ago. The most valuable part of the plan for me is that it establishes jurisdiction. Sidewalk between 60 the Fenway and main walkway. This problem quarantines residents of 66 the Fenway.   &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;    &lt;p class="MsoNormal"&gt;&lt;span style=""&gt; &lt;o:p&gt;&lt;/o:p&gt;4.  Fenway crosswalk just south of Boston Fire Alarm, 59 The Fenway.  Also adjacent curb cut at the northern edge of the service road.  &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;    &lt;p class="MsoNormal"&gt;&lt;span style=""&gt;5.  Agassiz Road crosswalk.   &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;    &lt;p class="MsoNormal"&gt;&lt;span style=""&gt;6. Curb cut at southern edge of service road.&lt;br /&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;br /&gt;7.  Sidewalk along The Fens from &lt;st1:place st="on"&gt;Agassiz&lt;/st1:place&gt; road heading south.  I saw high school students walking in the road on Monday, December 17.&lt;/span&gt;&lt;/p&gt;&lt;/blockquote&gt;&lt;p class="MsoNormal"&gt;&lt;span style=""&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt; &lt;span style="font-weight: bold;"&gt;Tuesday&lt;/span&gt;:&lt;br /&gt;A truck with sand  backed to and fro across the crosswalk at Agassiz road/the Fenway (#5 in the map), for what seems like quite some time, before just driving off and doing nothing.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight: bold;"&gt;Wednesday:&lt;br /&gt;&lt;/span&gt;&lt;span&gt;A work (prison work release?) crew  comes to the same crosswalk&lt;/span&gt;&lt;span style="font-weight: bold;"&gt;, &lt;/span&gt;&lt;span&gt;mostly stands around with only a few shovels, and clears a few feet of the curb cut on each side of the crosswalk.  Beyond each cleared patch it remains solid ice. But property owners that never bother to shovel their curb cuts have only a ticket to fear, and probably not even that.  The prospect of receiving a ticket, out of the 250 tickets written across probably a half million parcels of sidewalk and curb cuts, isn't much to worry about.&lt;br /&gt;&lt;br /&gt;The complete failure of snow removal from the sidewalks and curb cuts of the city calls out for an additional measure of enforcement.  Just as cars get towed  when they become a threat to public safety, so should sidewalks and curb cuts be shoveled --&lt;span style="font-weight: bold;"&gt; by the public entity responsible for public safety&lt;/span&gt; -- when they become a threat. Kelly&lt;br /&gt;&lt;br /&gt;The surprise advent of a Norlund Inverted Coastal Trough, which has today shown up on weather maps as a black dotted line tailing away from the now-distant storm, has meant for a lot more snow than anticipated.-- 8 inches rather than one or two.  The snow is now wrapping up, which means that tomorrow will be a great test of Boston's new snow removal ordnance.&lt;br /&gt;&lt;br /&gt;The &lt;a href="http://www.neighborhoodaccess.org/2007/12/bostons-new-snow-removal-ordinance.html"&gt;unanimously-passed ordinance&lt;/a&gt; specifies how snow and ice should be cleared from the city's sidewalks and curb cuts, and increases fines for violators. Kelly&lt;/span&gt;&lt;p class="MsoNormal" style="font-style: italic;"&gt;The Boston Globe reported today that&lt;br /&gt;&lt;span style=""&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style=""&gt;&lt;span style=""&gt;&lt;/span&gt;&lt;/p&gt;&lt;p class="MsoNormal" style=""&gt;  &lt;/p&gt;&lt;p class="MsoNormal" style=""&gt;&lt;span style=""&gt;&lt;/span&gt;&lt;/p&gt;&lt;blockquote&gt;&lt;p class="MsoNormal" style=""&gt;&lt;span style=""&gt; Since last Thursday's storm, &lt;st1:city st="on"&gt;&lt;st1:place st="on"&gt;Boston&lt;/st1:place&gt;&lt;/st1:city&gt;'s Inspectional Services Department has issued some 250 tickets with fines of $50 for residents and $150 for businesses.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style=""&gt;&lt;span style=""&gt;The city can also ticket the state, but so far has opted not to.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style=""&gt;&lt;span style=""&gt;"The state's got a large area," said Boston Police Captain Michael Mackan, who heads code enforcement. "If we get a complaint about one of their areas or the MBTA's, I'll call them, and I know they'll get out there and take care of it. . . . Things fall through the cracks."&lt;/span&gt;&lt;/p&gt;&lt;/blockquote&gt;&lt;p class="MsoNormal" style=""&gt;&lt;span style=""&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style=""&gt;&lt;/p&gt;&lt;blockquote&gt;&lt;/blockquote&gt;I contacted the governor's office, and sent in a detailed map with accompanying pictures of unshoveled walkways in the Fenway. &lt;br /&gt;&lt;br /&gt;A work crew showed up today, and cleared about 5 feet worth of the ramp on either side of Agassiz road. After that cleared 5 feet, it was all ice.&lt;br /&gt;&lt;br /&gt;The crosswalk above, one of the most important in the neighborhood, is even marked as a "medium priority" by the Department of conservation and recreation. Kelly&lt;br /&gt;&lt;br /&gt;Boston Globe arts reporter (and&lt;a href="http://www.boston.com/news/globe/magazine/articles/2007/09/16/access_denied/"&gt; access advocate&lt;/a&gt;) Geoff Edgers's &lt;span style="font-weight: bold;"&gt;Boston.com&lt;/span&gt; blog, "&lt;a href="http://www.boston.com/ae/theater_arts/exhibitionist/"&gt;Exhibitionist,"&lt;/a&gt; is devoted to the arts, but that didn't stop him from posting the above picture of me squeezed between a car and a hard slush at the corner of Westland Avenue and Hemenway Street.&lt;br /&gt;&lt;br /&gt;I had sent Geoff and a bunch of other people an &lt;a href="http://flickr.com/photos/neighborhood_access_group/sets/72157603470079075/"&gt;e-mail invitation&lt;/a&gt; to view 35 pictures of access violations in the Fenway, but until the &lt;a href="http://www.boston.com/ae/theater_arts/exhibitionist/2007/12/not_clearing_si.html"&gt;the picture hit Boston.com&lt;/a&gt;, it had received a total of 59 views. After the exposure, views went over 3000.&lt;br /&gt;&lt;br /&gt;People responded so enthusiastically to his posting that 16 comments came in within hours, that he&lt;a href="http://www.boston.com/ae/theater_arts/exhibitionist/2007/12/exhibitionist_f.html"&gt; put up another posting&lt;/a&gt; about this representing the most feedback he had ever gotten on a blog item.&lt;br /&gt;&lt;br /&gt;The &lt;a href="http://www.boston.com/ae/theater_arts/exhibitionist/2007/12/not_clearing_si.html"&gt;comments &lt;/a&gt;make great reading, in large part because people are remarkably honest.  One fellow, Ben, asks the big question:&lt;br /&gt;&lt;blockquote&gt;what should we expect people to do about this? It is nearly impossible to have all of the snow and ice cleared from the sidewalks and roadways the day or two after a big storm. Our New England meteorological/Climate conditions and available human resources just do not allow for it. We should feel bad that this situation creates significant impairments to handicap access around the city, but realistically what can be done about it? Please make some feasible suggestions as to what accomodations should be made.&lt;br /&gt;&lt;blockquote&gt;&lt;/blockquote&gt;&lt;/blockquote&gt;The answer is to change from doing what doesn't work to what might work.  Bill Allan of the disability policy consortium suggests hiring people to shovel, and I think that is the right direction.  Let's make it neighborhood-based, and have competitions between the neighborhoods on which can be the safest after a snowstorm.  The group that could provide the most leadership would be teenagers, junior high and high school students.  They could have competitions against each other, they could document violations, and be empowered to turn in evidence against violators.  They would have a list of elderly and disabled people whose homes should be shoveled out as a public service.&lt;br /&gt;&lt;br /&gt;All that is needed is the political will.&lt;br /&gt;&lt;br /&gt;But I ran into the reality that he describes today, when Patty Provenzano, DCR director of community relations, told me that not only would it be impossible to clear the snow in my or any neighborhood within the three hour limit set by the city, but that DCR isn't even bound to by city regulations.  I asked her, "are you sure?" She said she was. I'm thinking that we will certainly have to see about that!&lt;br /&gt;&lt;br /&gt;I called inspectional services, and got the "hold on," followed 25 seconds later by the sudden cut off. It's amazing how many times I get "accidentally" cut off when I am making a complaint about being excluded from the streets of the city. Kelly&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;The heavy wet snow fall from earlier in the morning has long since turned to rain.&lt;span style=""&gt;  &lt;/span&gt;The temperature is now comfortably above freezing (40° out my window at 3:52 p.m.), so the snow is shovelable (if wet), but time is running out.&lt;span style=""&gt;  &lt;/span&gt;With a deep freeze coming in tonight that will last through the week, the grim probability is that very little shoveling of any kind will get done by tonight.&lt;span style=""&gt;  &lt;/span&gt;  &lt;p class="MsoNormal"&gt;There never has been an effective penalty for not shoveling, so why should anyone bother?&lt;/p&gt;  &lt;p class="MsoNormal"&gt;What we can expect the next is that peculiarly Bostonian "act of nature" mentality, in which nothing can be done about the snow and ice blocking the sidewalks, and we all must resign ourselves to waiting for the warming rays of the December sun.&lt;br /&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;Meanwhile, government and media concentrate on road clearance, perhaps because as a group they all drive cars.&lt;span style=""&gt;  &lt;/span&gt;The hundreds of thousands of people in the metropolitan region who don't use automobiles are thrown off the sidewalks, tethered to our houses, or admitted to emergency rooms. &lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;st1:place st="on"&gt;&lt;st1:city st="on"&gt;Boston&lt;/st1:city&gt;&lt;/st1:place&gt; inspectional services, with its tiny core of inspectors, will write a few hundred tickets and call that a success.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;If this approach works so well, why don't we switch to having abutters clear roadways and highways, too? &lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="font-weight: bold;"&gt;Getting back to reality, &lt;/span&gt;I decided I had to do everything in my power to get these sidewalks cleared before the ice cometh.&lt;span style=""&gt;  &lt;/span&gt;I called up the main DCR number, got an emergency number, and was very politely referred to the Storm Center at 617-727-1680.&lt;span style=""&gt;  &lt;/span&gt;This is the number I have often called regarding snow emergencies and HP parking thieves.&lt;/p&gt;  &lt;p class="MsoNormal"&gt;"Hello, my name is John Kelly from Neighborhood Access Group in the Fenway.&lt;span style=""&gt;  &lt;/span&gt;And I'm calling to find out when the DCR plans to shovel off the walkways in the Fenway."&lt;/p&gt;  &lt;p class="MsoNormal"&gt;DCR: "We have crews going out at four or 5 p.m., but I can't give you a time.&lt;span style=""&gt;  &lt;/span&gt;Where you talking about"&lt;/p&gt;  &lt;p class="MsoNormal"&gt;NAG: "The walkways in the Fenway, in my neighborhood.&lt;span style=""&gt;  &lt;/span&gt;The service road near 60 the Fenway, a walkway towards the Westland Gates, all this is DCR property.&lt;span style=""&gt;  &lt;/span&gt;The sidewalk along The Fens between 60 and 114 The Fenway hasn't been touched since the Thursday storm"&lt;/p&gt;  &lt;p class="MsoNormal"&gt;DCR: "Were adding people all the time.”&lt;/p&gt;  &lt;p class="MsoNormal"&gt;NAG: "But do you plan to follow the law regarding clearing the snow?"&lt;/p&gt;  &lt;p class="MsoNormal"&gt;DCR: "We've got 24 hours."&lt;/p&gt;  &lt;p class="MsoNormal"&gt;NAG: "In &lt;st1:place st="on"&gt;&lt;st1:city st="on"&gt;Boston&lt;/st1:city&gt;&lt;/st1:place&gt;, you've got three hours."&lt;/p&gt;  &lt;p class="MsoNormal"&gt;DCR: "Hold on."&lt;br /&gt;&lt;/p&gt;&lt;p class="MsoNormal"&gt;&lt;click&gt;&lt;click&gt;&lt;click&gt;&lt;span style=""&gt;&lt;/span&gt;&lt;span style="font-style: italic;"&gt;We become disconnected.&lt;/span&gt;&lt;/click&gt;&lt;/click&gt;&lt;/click&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;"Hello, this is John Kelly from Neighborhood Access Group again."&lt;/p&gt;  &lt;p class="MsoNormal"&gt;DCR: "Yeah we got cut off. Kelly&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;Sometimes, the Boston city Council is able to make strides towards improving the lives of people in the region. Fresh for this snow season, we have a new and improved snow clearance ordnance. The bill came out of the office of outgoing city councilor Felix Arroyo, and was cosponsored by  returning councilors Mike Ross and Charles Yancey.&lt;br /&gt;&lt;br /&gt;The previous law was confusing and practically worthless.  On the one hand, the ordinance required sidewalks to be totally cleared within three hours of the end of the snow fall, but only threatened  a $15 fine against scofflaw homeowners, and only $50 for commercial establishments.&lt;br /&gt;&lt;br /&gt;Rational calculation would lead many abutters of sidewalks and curb cuts to conclude that  it would be cheaper to pay the fine than to hire someone to clear the snow.  And because tickets in Boston are written by the inspectional services division (is it 16 inspectors?)  rather than parking control officers (are there hundreds?  I see them everywhere) as in Cambridge, people have little to fear.&lt;br /&gt;&lt;br /&gt;So here is a partial solution.  There are some good "Whereases" in the bill, which was primarily written by Arroyo chief of staff Jamie Wilmuth, unless I'm mistaken.  Advocate John Marshall also played a key role.&lt;br /&gt;&lt;br /&gt;&lt;p class="MsoHeader" style=""&gt;&lt;span style="font-size:130%;"&gt;&lt;b style=""&gt;Offered by Councillors FELIX D.   &lt;/span&gt;&lt;/i&gt;&lt;span style=""&gt;This failure to adequately remove snow and ice from the City’s sidewalks results in a lack of reasonable access and mobility for wheelchair users, the elderly, the disabled and other residents, and causes significant public safety issues; and&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 71.25pt; text-align: justify; text-indent: -71.25pt;"&gt;&lt;b&gt;&lt;span style=""&gt;WHEREAS:&lt;span style=""&gt;   &lt;/span&gt;&lt;/span&gt;&lt;/b&gt;&lt;span style=""&gt;A particular concern is the failure by many residents and business to shovel abutting curb ramps/cuts, a legal obligation under the current law of which many residents and businesses are unaware; and&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 71.25pt; text-align: justify; text-indent: -71.25pt;"&gt;&lt;b&gt;&lt;span style=""&gt;WHEREAS:&lt;span style=""&gt;   &lt;/span&gt;&lt;/span&gt;&lt;/b&gt;&lt;span style=""&gt;The existing City Sidewalk Ordinance (CBC CHAPTER 16-12.16) contains few specific guidelines concerning clearing of snow or ice; and&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 71.25pt; text-align: justify; text-indent: -71.25pt;"&gt;&lt;b&gt;&lt;span style=""&gt;WHEREAS:&lt;span style=""&gt;   &lt;/span&gt;&lt;/span&gt;&lt;/b&gt;&lt;span style=""&gt;The Ordinance’s fine for failing to shovel one’s sidewalk and abutting curb ramps/cuts is only fifteen ($15.00) dollars for residents and only fifty ($50.00) dollars for non-residential properties, fines which are not large enough to ensure full compliance with the Ordinance; and&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 71.25pt; text-align: justify; text-indent: -71.25pt;"&gt;&lt;b&gt;&lt;span style=""&gt;WHEREAS:&lt;/span&gt;&lt;/b&gt;&lt;i style=""&gt;&lt;span style=""&gt;   &lt;/span&gt;&lt;/i&gt;&lt;span style=""&gt;The Boston City Council believes that clarifying the snow and ice clearing law while increasing the fines for failing to shovel sidewalks and abutting curb ramps would help alleviate these problems and ensure safe accessibility to City sidewalks for everyone. &lt;span style=""&gt; &lt;/span&gt;&lt;/span&gt;&lt;i style=""&gt;NOW THEREFORE,&lt;/i&gt;&lt;span style=""&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoHeader"&gt;&lt;b style=""&gt;&lt;i style=""&gt;&lt;span style="font-size:12;"&gt;Be it ordained by the City Council of &lt;st1:place st="on"&gt;&lt;st1:city st="on"&gt;Boston&lt;/st1:city&gt;&lt;/st1:place&gt;, as follows:&lt;/span&gt;&lt;/i&gt;&lt;/b&gt;&lt;span style="font-size:12;"&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;u&gt;Section1.&lt;o:p&gt;&lt;/o:p&gt;&lt;/u&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;CBC Chapter XVI is hereby amended by striking Section 16-12.16 (“Removal of Snow and Ice”) in its entirety and replacing it as follows:&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 0.75in; text-indent: -0.75in;"&gt;&lt;!--[if !supportLists]--&gt;&lt;b&gt;&lt;span style=""&gt;16-12.16&lt;span style=";font-family:&amp;quot;;font-size:7;"  &gt;        &lt;/span&gt;&lt;/span&gt;&lt;/b&gt;&lt;!--[endif]--&gt;&lt;b&gt;Snow, Slush, and Ice on Sidewalks.&lt;o:p&gt;&lt;/o:p&gt;&lt;/b&gt;&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 37.05pt; text-indent: -19.95pt;"&gt;(a)&lt;span style=""&gt;  &lt;/span&gt;&lt;i&gt;Requirements for snow and/or slush.&lt;/i&gt;&lt;span style=""&gt;  &lt;/span&gt;No owner, manager, or tenant of a (i) commercial building, estate, or land abutting on a sidewalk, (ii) mixed-use building, estate, or land abutting on a sidewalk, or (iii) residential building, estate, or land abutting on a sidewalk, containing more than six (6) residential dwelling units shall place or suffer to remain in place for more than three (3) hours between sunrise and sunset any slush or any loose, granular, or packed snow upon such sidewalk.&lt;span style=""&gt;  &lt;/span&gt;Removal of any slush or snow should be conducted along the full paved width of such sidewalk and in a manner that ensures the orderly flow and safety of pedestrian traffic upon such sidewalks.&lt;span style=""&gt;  &lt;/span&gt;Removal of any slush or snow shall be conducted in a manner that clears the full paved path or a minimum of forty-two (42) inches wide.&lt;span style=""&gt;  &lt;/span&gt;Each day that a violation exists shall be considered a separate and distinct violation.&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 37.05pt; text-indent: -19.95pt;"&gt;&lt;span style=""&gt;       &lt;/span&gt;No owner, manager, or tenant of a residential building, estate, or land abutting on a sidewalk containing six (6) or fewer residential dwelling units shall place or suffer to remain in place for more than six (6) hours between sunrise and sunset any slush or any loose, granular, or packed snow upon such sidewalk.&lt;span style=""&gt;  &lt;/span&gt;Removal of any ice shall be in a manner consistent with the requirements of the preceding sub-section, except that any such owner, manager, or tenant shall be deemed to be in compliance with this paragraph if such ice is made level and completely covered with sand, sawdust, or other appropriate material to prevent slipping.&lt;span style=""&gt;  &lt;/span&gt;Each day that a violation exists shall be considered a separate and distinct violation.&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 37.05pt; text-indent: -19.95pt;"&gt;&lt;span style=""&gt;       &lt;/span&gt;No owner, manager, or tenant of a residential building, estate, or land abutting on a sidewalk containing six (6) or fewer residential dwelling units shall place or suffer to remain in place for more than six (6) hours between sunrise and sunset any ice upon such sidewalk.&lt;span style=""&gt;  &lt;/span&gt;Removal of any ice shall be in a manner consistent with the requirements of the preceding sub-section, except that any such owner, manager, or tenant shall be deemed to be in compliance with this paragraph if such ice is made level and completely covered with sand, sawdust, or other appropriate material to prevent slipping.&lt;span style=""&gt;  &lt;/span&gt;Each day that a violation exists shall be considered a separate and distinct violation.&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 37.05pt; text-indent: -19.95pt;"&gt;(c)&lt;span style=""&gt;  &lt;/span&gt;No person shall remove slush, snow, or ice from privately-owned real property and place it upon any sidewalk or street.&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 36.6pt; text-indent: -19.5pt;"&gt;&lt;!--[if !supportLists]--&gt;&lt;span style=""&gt;(d)&lt;span style=";font-family:&amp;quot;;font-size:7;"  &gt;    &lt;/span&gt;&lt;/span&gt;&lt;!--[endif]--&gt;Enforcement/Penalties.&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 57pt; text-indent: -19.95pt;"&gt;(i)&lt;span style=""&gt;    &lt;/span&gt;Any violation of subsection (a) or subsection (b) occurring at a sidewalk abutting land zoned solely for residential use and that has six (6) or fewer residential units shall result in a fine of fifty dollars and no cents ($50.00) for each such violation.&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 57pt; text-indent: -19.95pt;"&gt;(ii)&lt;span style=""&gt;   &lt;/span&gt;Any violation of subsection (a) or subsection (b) occurring at a sidewalk abutting land zoned solely for residential use and that has more than six (6) residential units or at a sidewalk abutting vacant land shall result in a fine of one hundred dollars and no cents ($100.00) for each such violation.&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 57pt; text-indent: -19.95pt;"&gt;(iv)&lt;span style=""&gt;  &lt;/span&gt;Any violation of subsection (a) or subsection (b) occurring at a sidewalk abutting any vacant land or land zoned for any use other than solely residential (commercial or mixed-use buildings) shall result in a fine of one hundred fifty dollars and no cents ($150.00) for each such violation.&lt;/p&gt;  &lt;p class="MsoNormal" style="margin-left: 57pt; text-indent: -19.95pt;"&gt;(v)&lt;span style=""&gt;   &lt;/span&gt;Any violation of subsection (c) shall result in a fine of two hundred fifty dollars and no cents ($250.00).&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;u&gt;Section 2.&lt;o:p&gt;&lt;/o:p&gt;&lt;/u&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;CBC Chapter XVI is hereby amended by striking in its entirety Section 16.32.1(a).&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;u&gt;&lt;span style="color:black;"&gt;Section 3.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/u&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;span style="color:black;"&gt;CBC Chapter XVI is hereby amended by striking the sixteenth (16th) paragraph from Section 16-32.6 which paragraph reads "Subsection 16.12.16&lt;span style=""&gt;  &lt;/span&gt;Such amendment as is provided in subsection 16-32.1;".&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;  &lt;p class="MsoNormal"&gt;&lt;u&gt;Section 4.&lt;o:p&gt;&lt;/o:p&gt;&lt;/u&gt;&lt;/p&gt; After asking five times over the last six months for a meeting with the governor, BCIL's Bill Henning and MetroWest's Paul Spooner led a delegation that promised to return "with sleeping bags" unless Governor Patrick finally agrees to a meeting. &lt;br /&gt;&lt;br /&gt;Advocates have been incensed over cuts totaling more than $1 million to community-based housing, and a prior denial of a small pay increase  for  personal care assistants, who make independent living possible for people with disabilities.&lt;br /&gt;&lt;br /&gt;Patrick was not in the office at the time, but his scheduler promised that if this coming Wednesday's already-scheduled meeting between advocates and Undersecretary of .Housing and Community Development Tina Brooks leaves people unhappy, the governor would attend a  meeting.  She refused to budge on scheduling such a meeting until after Wednesday, even though advocates said that Brooks would be unable to meet the varied list of demands.&lt;br /&gt;&lt;br /&gt;But based on her repeated promise, it does seem that a meeting with Patrick will happen some time in the next few weeks or so. &lt;br /&gt;&lt;br /&gt;This past summer, the Patrick administration argued that it had no authority to agree to a recommended pay increase for personal care assistants, which had been recommended by the state's ratesetting commission.
